Terms of Service — MotoRival

1. Acceptance of terms

By using MotoRival, you accept these Terms of Service. If you don’t agree, don’t use the app.

These terms may evolve. We’ll notify you inside the app when a substantial change happens. Your continued use of the app after a change means acceptance.

2. Who we are

MotoRival is a territory-capture game for motorcyclists, built by AppSprint (independent studio). The app isn’t affiliated with any motorcycle manufacturer, gear brand, or sports federation.

3. Account and identification

No login, no password. A unique identifier (Device ID) is generated locally on your iPhone the first time you open the app. That ID is also stored in the Despia iCloud keychain so it survives a reinstall.
Public handle. Your handle appears on leaderboards and public profiles. It must respect moderation rules (no hate, no incitement to violence, no sexual content).
Uniqueness. One iPhone = one MotoRival account. No multi-accounting to bypass free tier limits.

4. What you can do, what you can’t do

Ride, capture territory, challenge other riders
Join or create a crew (max 8 members)
Subscribe to Rival Pass to unlock premium features
Share your stats on social media

Not OK

Use the app while riding (looking at the screen, tapping, interacting)
Falsify your GPS location (GPS spoofing — automatic detection, permanent ban)
Harass, threaten, or dox another rider via handle or crew
Reverse-engineer the app, intercept API requests, or exploit bugs for advantage (legit bug bounty: write to support@motorival.app)
Use the app for illegal activity (street racing on public roads, fleeing police, etc.)

We reserve the right to suspend or delete any account that violates these rules, without notice and without refund.

5. Safety — essential clause

Motorcycling is a high-risk activity. MotoRival is a game, not a navigation tool, not a riding assistant, not safety equipment.

You alone are responsible for:

Your speed and road behaviour
Your protective gear
Compliance with traffic law
Your physical and mental fitness before riding

MotoRival, its developer, and its partners disclaim all liability for any accident, injury, death, or property damage linked to use of the app.

Never look at your phone while riding. Mount it on a holder. Riding Mode (2 big Pause/Stop buttons) is designed for that — but even Riding Mode shouldn’t be used at full speed.

6. Rival Pass subscription

Billing: Apple handles all payments via the App Store. MotoRival never sees your credit card.
Renewal: subscriptions auto-renew at the end of each period. Cancel at least 24h before the end of the period in iOS Settings → Your Name → Subscriptions.
Refund: no partial refund is possible on MotoRival’s side (Apple policy). Request a refund directly from Apple at reportaproblem.apple.com.
Pricing: displayed prices are those of your local store. We reserve the right to change prices at any time — a change only applies to new subscriptions or to renewals after notification.

7. Intellectual property

MotoRival’s code, design, and trademarks belong to AppSprint.
Your ride data (GPS traces, territory, stats) belong to you. We store them to run the game, but you can request deletion at any time via Settings → Delete my account.

8. Limitation of liability

To the extent permitted by law:

The app is provided “as is” and “as available”.
We don’t warrant the absence of bugs, the accuracy of rankings, or continuous service availability.
Our total cumulative liability to you is capped at the amount paid for your subscription in the last 12 months (zero if you’re on free tier).

Nothing in these terms limits our liability for gross negligence, wilful misconduct, or personal injury caused by our negligence.

9. Governing law & jurisdiction

These terms are governed by Swiss law. Any dispute will be submitted to the competent courts of Geneva, Switzerland.

If you are a consumer residing in the EU, you may benefit from the mandatory provisions of the law of your country of residence.
